Nothing in these Terms affects statutory rights that cannot legally be excluded or restricted.
1. What Ghost does
Ghost is designed to help you intentionally make selected apps, categories or websites less accessible on your iPhone.
You choose what disappears.
Ghost uses Apple's Family Controls and Managed Settings technologies to apply restrictions supported by iOS.
Parts of the resulting experience, including system shields, orientation, permissions, operating-system behaviour and availability of Apple frameworks, are controlled by Apple rather than Ghost.
2. Compatibility
Ghost requires a compatible Apple device, supported version of iOS and any Apple permissions or capabilities necessary for the feature being used.
You are responsible for checking compatibility information shown before purchasing a Ghost product.
Apple may modify iOS, Family Controls, Managed Settings, StoreKit, NFC behaviour or other technologies Ghost depends upon.
We may update Ghost where reasonably necessary to maintain compatibility, security or functionality.
3. Choosing what Ghost blocks
You control the applications, categories and websites you select.
You should consider carefully whether to restrict anything you may need urgently or critically, including communication, travel, safety, healthcare or work-essential services.
Ghost is an attention and digital-wellbeing product.
It is not an emergency, medical, safety or security service.
4. Reservations
At the date of these Terms, tapghost.com allows users to reserve or register interest in a physical Ghost card without payment.
A free reservation:
- is not a completed purchase;
- does not guarantee availability;
- does not guarantee a final price;
- does not guarantee a manufacturing or delivery date;
- does not require you to purchase a card later.
Any price displayed alongside a reservation before payment is taken is indicative only unless clearly stated otherwise.
We may contact you where necessary to administer your reservation, tell you about its availability or give you the opportunity to purchase Ghost.
Broader marketing emails will only be sent where an appropriate legal basis exists, including where you have separately opted in.
You may withdraw your reservation at any time by emailing hello@tapghost.com.
5. Paid pre-orders and physical products
If we introduce paid pre-orders or direct physical-product sales, the relevant product page or checkout will state the price, delivery charges, expected delivery or dispatch period and other material terms before you place the order.
A paid order becomes binding when we accept it and send an order confirmation, unless the checkout expressly states otherwise.
For a pre-order, an estimated future delivery or dispatch period may be agreed as part of the order.
If circumstances materially delay a pre-order, we will provide information about the delay and any rights available to you.
The separate Returns & Refunds Policy forms part of these Terms for physical products.
6. Digital Ghost purchases
Digital Ghost access may be purchased through Apple's App Store using StoreKit.
Apple processes the transaction and payment.
Any Apple purchase is also subject to the terms applicable to your Apple Account and the App Store.
Where a digital Ghost entitlement is described as a non-consumable purchase, it provides the entitlement described on the purchase screen. It does not transfer ownership of the Ghost software or intellectual property to you.
7. Ghost card access
Where a physical Ghost card includes or enables access to the Ghost app, the relevant product description or checkout will state what access is included.
Ghost may periodically verify a card entitlement through our backend.
Temporary network failure should not normally remove an entitlement that remains locally valid, but online access may periodically be required to refresh or verify it.
8. NFC functionality
Where Ghost uses NFC, operation depends partly on Apple's hardware and operating-system behaviour.
An NFC interaction may require your iPhone to be awake and may display an Apple system notification requiring user action.
Unless expressly stated otherwise, Ghost does not guarantee that an NFC card will silently or automatically open an app without user interaction.
9. Your licence to use Ghost
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Ghost software for its intended purpose, subject to these Terms and Apple's applicable platform rules.
You do not acquire ownership of Ghost software, branding, designs, code or other intellectual property.
10. Acceptable use
You must not intentionally:
- use Ghost unlawfully;
- interfere with the operation or security of the service;
- attempt to obtain unauthorised access to Ghost systems;
- misuse verification, reviewer or entitlement mechanisms;
- copy, resell or commercially exploit Ghost software except where we expressly permit it;
- reverse engineer the service except to the extent applicable law expressly permits this despite these Terms.
11. Availability and interruptions
We aim to provide Ghost reliably but cannot promise uninterrupted or error-free availability.
Ghost relies on third-party systems including Apple, internet connectivity, Supabase and other service infrastructure.
We may temporarily suspend or change parts of Ghost where reasonably necessary for maintenance, security, compatibility, legal compliance or product development.
12. Updates and changes
Ghost is an evolving product.
We may improve, modify or replace features over time.
We will not use these Terms to remove mandatory consumer rights or avoid obligations that apply to paid products.
13. Intellectual property
The Ghost name, branding, visual identity, website, app design, graphics, software and other original materials are owned by or licensed to Ghost.
You may not use them commercially without permission.
14. Third-party services
Ghost depends on services provided by third parties, including Apple.
Your use of those services may also be governed by the third party's own terms.
Ghost is not responsible for independent changes made by third-party platforms outside our reasonable control, although this does not affect any responsibility we have under applicable consumer law.
15. Our responsibility to consumers
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the relevant contract was made.
Ghost is provided primarily for personal use. If you use it for business purposes, we are not responsible for business losses such as lost profit, revenue, opportunity or business interruption to the extent permitted by law.
Nothing in these Terms affects your rights under applicable consumer law.
16. Refunds
Digital purchases made through Apple's App Store are generally administered through Apple's purchase and refund systems, subject to applicable consumer law.
Physical Ghost products purchased directly from Ghost are covered by our Returns & Refunds Policy.
17. Ending your use of Ghost
You can stop using Ghost at any time.
We may restrict access where reasonably necessary because of fraud, abuse, security risks or serious breach of these Terms.
Where you have paid for access, any restriction will be handled consistently with applicable consumer law and your statutory rights.
18. Privacy
Our use of personal information is explained in the Ghost Privacy Policy at /privacy.
19. Changes to these Terms
We may update these Terms when Ghost changes or where legal or regulatory requirements change.
Where a change materially affects an existing paid service, we will take reasonable steps to notify affected users where appropriate.
20. Governing law
These Terms are governed by the laws of England and Wales.
If you are a UK consumer, this does not deprive you of mandatory protections provided by the law where you live, and you may bring proceedings in the courts available to you under applicable consumer law.
